Welcome to Athlete Quotient. By accessing or using our website at athletequotient.com (the "Site") or any services provided by Athlete Quotient, Inc. ("AQ," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our Services.

1. Not Medical Advice

IMPORTANT: Athlete Quotient is not a medical provider. The information, scores, assessments, training recommendations, and development plans provided through our platform are for informational and educational purposes only. They do not constitute medical advice, diagnosis, or treatment. Always consult a qualified physician or healthcare provider before beginning, modifying, or discontinuing any exercise program, training regimen, or physical activity - especially for minors. If you experience pain, injury, dizziness, or any adverse physical symptoms during training, stop immediately and seek medical attention.

2. Not Professional Athletic Counseling

AQ scores, development plans, level fit classifications, and recruiting readiness assessments are generated using proprietary algorithms and benchmark data. They are tools to inform your decision-making, not guarantees of athletic outcomes. Athlete Quotient does not guarantee admission to, recruitment by, or scholarship offers from any college, university, athletic program, or professional sports organization. Athletic performance, recruiting, and admissions decisions depend on many factors beyond what any platform can measure.

3. No NCAA, NAIA, or Institutional Affiliation

Athlete Quotient is an independent company. We are not affiliated with, endorsed by, or sponsored by the National Collegiate Athletic Association (NCAA), the National Association of Intercollegiate Athletics (NAIA), any college or university, any high school athletic association, or any professional sports league. References to "D1," "D2," "D3," "NAIA," "JUCO," and similar terms refer to competition levels and are used for benchmarking purposes only. Our benchmark data is compiled from publicly available sources and proprietary research and may not reflect the current standards of any specific institution or program.

4. Benchmark Data and Scoring Accuracy

The AQ score and all related metrics are based on statistical models and benchmark data that represent general performance standards. While we strive for accuracy, we do not warrant that our benchmarks, scores, percentile rankings, or level fit classifications are error-free, complete, or reflective of every institution's specific recruiting standards. Benchmark data is updated periodically and may not reflect the most current standards at any given institution. AQ scores should be used as one data point among many in making athletic and educational decisions.

5. Training and Development Recommendations

Training plans, workout recommendations, technique cues, and development priorities provided by Athlete Quotient are general guidance based on your assessment data. They are not personalized medical or physical therapy prescriptions. Individual results may vary based on genetics, effort, consistency, coaching quality, nutrition, rest, injury history, and many other factors. Athlete Quotient is not responsible for any injury, loss, or damage resulting from following training recommendations provided through the platform.

6. Assumption of Risk

Participation in athletic training and sports activities carries inherent risks of injury, including but not limited to sprains, strains, fractures, concussions, and other physical harm. By using Athlete Quotient's training recommendations, assessment protocols, or participating in AQ-affiliated events, you acknowledge and voluntarily assume these risks. For users under 18, a parent or legal guardian must acknowledge these risks on the minor's behalf.

7. Users Under 18 (Minors)

Athlete Quotient serves athletes of all ages, including minors under the age of 18. For users under 13, we comply with the Children's Online Privacy Protection Act (COPPA) and require verifiable parental consent before collecting personal information. For users between 13 and 17, we strongly recommend that a parent or legal guardian review these Terms of Service, our Privacy Policy, and any assessment results or training recommendations. Parents and guardians are responsible for supervising their minor's use of the platform and any training activities undertaken based on AQ recommendations.

8. Coach Network Disclaimer

Coaches, trainers, and assessment partners listed on the Athlete Quotient platform are independent professionals, not employees or agents of Athlete Quotient. While we require coaches to complete our certification program, we do not control, supervise, or guarantee the quality, safety, or outcomes of any coaching session, training program, or assessment event conducted by independent coaches or partners. Athlete Quotient is not liable for any injury, loss, or damage resulting from interactions with coaches or partners found through our platform. We encourage users to independently verify the qualifications, certifications, insurance, and background of any coach before engaging their services.

9. Rankings and Comparisons

Rankings displayed on the Athlete Quotient platform (city, state, national, and position-level) are based on AQ scores submitted by platform users. Rankings reflect only the population of athletes who have been assessed on our platform and do not represent all athletes in a given geography, sport, or position. Rankings update periodically and may fluctuate as new athletes join the platform or existing athletes reassess. AQ rankings are not endorsed by or affiliated with any governing body, athletic association, or media organization.

10. No Guarantee of Results

Athlete Quotient provides tools, data, and insights to support athletic development. We do not guarantee any specific outcome, including but not limited to improvements in athletic performance, increases in AQ score, college recruitment, scholarship offers, roster spots, or playing time. Success in athletics depends on effort, talent, opportunity, coaching, health, and many other factors that Athlete Quotient cannot control or predict.

11. Intellectual Property

All content on the Athlete Quotient platform - including but not limited to the AQ scoring methodology, benchmark data, training protocols, website design, logos, text, graphics, and software - is the property of Athlete Quotient, Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our platform or content without our prior written consent.

12. User-Submitted Data

You are responsible for the accuracy of any data you submit to the platform, including athletic metrics, academic information, and personal details. Submitting false, misleading, or inaccurate information may result in inaccurate AQ scores and recommendations and may lead to suspension or termination of your account. Athlete Quotient reserves the right to verify submitted data and to distinguish between self-reported and verified assessments.

13. Limitation of Liability

To the maximum extent permitted by law, Athlete Quotient, Inc., its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of or inability to use the Services, any content or recommendations provided through the Services, any conduct or content of any third party on the Services, or any injury sustained during athletic training or competition. Our total liability for any claim arising out of or relating to these Terms or our Services shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

14. Indemnification

You agree to indemnify, defend, and hold harmless Athlete Quotient, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another party.

15. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, conducted in Travis County, Texas. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

16. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware and applicable federal laws, without regard to conflict of law principles.

17. Changes to These Terms

We may update these Terms of Service from time to time. When we make material changes, we will update the "Last Updated" date and notify registered users by email. Your continued use of the Services after any changes constitutes your acceptance of the updated Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
